Should I give a statement to the other drivers insurance company?

Generally, no unless you are not injured and only want your car repaired.  Even then be very careful, as the insurance company will use it against you in trying to deny the claim.  I recommend that you contact the attorney of your choosing before giving any recorded statements.  Adjusters go to classes to learn how to get answers they want to important questions.

The adjuster said they are accepting responsibility will I get paid?

Most of the time you will get an offer from the insurance company for your injuries after they “accept responsibility” for your auto accident injury claim but it has been my experience that very few are given fair offers.  Also, your statement can affect any offer and also be a basis for the adjuster to deny the claim.

What can I do to document the accident?

  • Take photos of the damaged part of your car, if the car is heavily damaged.
  • Take down witnesses and police officers names and telephone numbers.
  • Keep insurance information for the negligent driver.
  • Keep all medical bills you receive even if they have been paid by your health insurance.
