A woman had been polishing her nails when she hit a motorcycle and killed the rider. Prosecutors charged the woman with criminal charges and tried the case to a jury.
After three and half hours the jury found the woman guilty as criminally reckless in the fatal crash, according to reports. The family of the deceased has vowed to help raise awareness of distracted driving.
While this case happened elsewhere, the same consequences are seen in Texas and in Houston when a driver is doing something other than driving.
Distracted driving is a big problem for Americans. Recently, with the explosion of texting and mobile e-mail the distracted driving problem has reached critical proportions.
Not only are criminal charges being filed and criminal cases won, but civil personal injury and wrongful death lawsuits are also obtaining substantial civil justice according to reported cases.
In situations such as polishing nails or as I wrote about recently, a truck driver viewing porn at the time of the wreck, exemplary damages should be considered by the court.
Punitive damages or exemplary damages are in a measure punishment in the form of money for conduct that was reckless and disregarded the safety of others.
